End-User License Agreement (EULA)

This End-User License Agreement (the "Agreement" or "EULA") is a legal contract between you, as a natural or legal person (the "User" or "you"), and Rolaxit Innovation SRL, as the owner and developer of the software (the "Developer").

By downloading, installing, copying, or otherwise using the Android application file (.apk) hereinafter referred to as the "Application", obtained through the website votrix.eu, you agree to comply with the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

1. Grant of license

The Developer grants you a limited, non-exclusive, non-transferable, revocable, and personal license to download, install, and use one copy of the Application in executable format (.apk) on your personal devices running the Android operating system, solely for personal and non-commercial purposes, in accordance with the terms of this document.

The Application, including but not limited to the source code, object code, graphical interface, visual elements, text, databases, and all associated copyrights, are and remain the exclusive property of the Developer (or its licensors, where applicable). This Agreement does not transfer to you ownership of the Application, but only a limited right to use it.

4. Updates and modifications

The Developer reserves the right to modify, update, or temporarily suspend the operation of the Application for maintenance, security, or service improvement. Although the Developer will make reasonable efforts to announce major changes in advance, these actions may be carried out at any time, with or without prior notice, depending on technical or security needs. Any update, patch, or new version of the Application shall be subject to the terms of this EULA, unless accompanied by a separate license. Because the application is delivered as an .apk file directly from votrix.eu, the user is responsible for downloading and manually installing future updates made available on the website.

5. Data collection and privacy

Use of the Application constitutes your consent for the Developer to collect and use technical data and related information (including but not limited to information about your device, operating system, and app usage) to facilitate updates, technical support, and product improvement. All personal data will be processed in accordance with the Privacy Policy available on votrix.eu.

6. Disclaimer of warranty

The Application is provided "as is" and "as available", without any warranty of any kind, express or implied. The Developer does not warrant that the Application will be available without interruptions, error-free, or completely secure. The User assumes the entire risk as to the quality and performance of the Application.

7. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable under any circumstances for direct, indirect, special, incidental, or consequential damages arising from the use of or inability to use the Application. This includes, but is not limited to, loss of profit, loss of data, damage to the Android device, or any other commercial damages or losses, even if the Developer has been advised of the possibility of their occurrence.

8. Termination

This Agreement is valid until terminated. Your rights under this EULA will terminate automatically, without notice from the Developer, if you fail to comply with any of the terms. Upon termination of the Agreement, you must cease all use of the Application and delete/uninstall all copies of the .apk file from all your devices.

9. Purchases, digital content and right of withdrawal

VoTriX is sold as digital content and online services. Purchases (activation codes, licenses, prepaid periods, credit and Premium options) are delivered and activated immediately after payment.

By completing a purchase and confirming that you want immediate access, you expressly request that performance begins immediately and you acknowledge that you therefore lose the 14-day right of withdrawal for digital content supplied without a tangible medium, in accordance with EU Directive 2011/83/EU and Romanian law (OUG 34/2014, art. 16 lit. m). Consequently, once the activation code has been delivered, purchases are non-refundable, except where required by mandatory law or in case of a proven, non-remediable technical fault attributable to the Developer.

10. Consumer dispute resolution (ANPC / ODR)

Consumers may address complaints to the Romanian National Authority for Consumer Protection (ANPC). Alternative dispute resolution (SAL) is available at anpc.ro/ce-este-sal, and the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

11. Governing law and disputes

This Agreement is governed by and construed in accordance with the laws of Romania. Any dispute arising out of or in connection with this Agreement shall be subject to the jurisdiction of the competent courts of Bucharest.
